Referral Terms and Conditions

By participating in the Home PC Patrol Referral Bonus Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Referring a customer directly (by you personally) or indirectly (the person you referred calls per your instruction) constitutes your acceptance of all terms and conditions of this agreement.

1. Eligibility: Every client of Home PC Patrol is eligible for the Home PC Patrol Referral Bonus Program. You become a referrer of Home PC Patrol when you refer a friend, family member, acquaintance, or business associate to Home PC Patrol for Computer Maintenance & Repair, Website Development, Graphic Design, or Marketing & Advertising services.

2. Persons Who May Be Referred: You must only refer Home PC Patrol to individuals with whom you have a pre-existing personal, social media, or business relationship and whom you believe would like to receive Home PC Patrol's services. Without limiting the generality of the foregoing, you must not obtain names for referral from i) group email addresses or ii) email mailing lists. You must not submit yourself for this referral bonus. Dependent children residing within the primary residence are eligible for the 10% discount to their service; however, it will not apply the corresponding 10% credit to the parents account.

3. Spamming: Home PC Patrol strictly forbids the sending of unsolicited e-mail to numerous recipients ("spamming") in attempt to generate referrals.

4. Number of Referral Bonuses: Home PC Patrol currently places no restrictions on the number of referral bonuses you may earn. This provision is subject to change at Home PC Patrol's sole discretion. Home PC Patrol will attempt to notify participating clients should this provision change in the future. Changes to this provision will not affect any referral credits 'banked' by the client prior to the change.

5. Referral Bonuses Credited to Your Account: For every business or individual that you refer to Home PC Patrol who satisfies the following bonus requirements, we will credit a 10% discount on a single service or maintenance plan to your Home PC Patrol account. A client will only be deemed to have been referred for the purposes of these Terms and Conditions if they:
(a) are not a current or past Home PC Patrol client
(b) purchase a service from Home PC Patrol totaling $100.00 or more prior to discount
(c) have had their payment processed by Home PC Patrol and have no past due charges

6. Expenditure of Discount Credits: Credits obtained through the Referral Bonus Program may be used on future Home PC Patrol services only. Discount credits applied are for a single item only and are not applied to the entire bill. For Example, if you have 7 Discount Credits saved up ('banked')and you have 3 computers currently under maintenance contract that are up for renewal; Home PC Patrol would apply your 7 Discount Credits to only 1 single PC. The result would be that you receive a 70% discount on one of the computer's maintenance fee, and pay full price for the remaining 2. There is no limitation to the number of Discount Credits that you can 'bank' or spend; except that it cannot in any circumstance exceed 100% of the total bill. Using the above example, a client with 33 discount credits would be eligible to spend 30 of their credits resulting in 100% discounts on all 3 PCs. The remaining 3 credits would remain 'banked' and would be available to apply to future services. Under no circumstances will the Discount Credits ever be redeemable for cash. Should you choose to cease utilizing Home PC Patrol's services, any 'banked' discount credits will remain associated with the account and available for use should you choose to utilize Home PC Patrol in the future.

7. Relationship of Parties: Clients participating in the Referral Bonus Program are acting of their own volition independent of Home PC Patrol. No money, wages, or commissions are paid to participants. Participants are eligible for discounts on future only services for providing Home PC Patrol with customer referrals; however those discounts hold no monetary value and cannot, in any circumstances, be redeemed for cash. Nothing in this agreement will constitute any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the client and Home PC Patrol. Clients have no authority to make or accept any offers or representations on Home PC Patrol's behalf, but may inform the prospective referral about the discount said referral will receive as a result of the Referral Bonus Program, should they choose to have Home PC Patrol provide them with services. Clients will not make any statement, whether in person, online, or otherwise, that would contradict anything in this agreement.

8. Home PC Patrol's Responsibilities: Home PC Patrol is solely responsible for providing services to customers and for billing and collecting money from customers for all Home PC Patrol services. To assist clients in their activities under this Agreement, Home PC Patrol may, in its discretion, provide sales and other materials (in electronic or printed format) with respect to the Home PC Patrol services as Home PC Patrol deems appropriate from time to time. The client agrees not to use any promotional materials other than the materials provided by or approved in writing by Home PC Patrol to promote the Referral Bonus Program. Home PC Patrol agrees to respond to your reasonable inquiries about developments with respect to services offered by Home PC Patrol which may be useful to you in the performance of your duties under this Agreement. You acknowledge and agree that Home PC Patrol has the right in its sole discretion without notice and without incurring any liability of any type to you or any third party: (a) to establish the terms and conditions under which it will offer or sell Home PC Patrol services to any prospective referral; or (b) to refuse to provide the Home PC Patrol services or terminate provision of services to any referral; (c) to set the price for all Home PC Patrol services and may change the prices charged to referrals for any Home PC Patrol service; and (d) your sole and exclusive remedy in case of any of the foregoing actions or inactions by Home PC Patrol is to make no further referrals to Home PC Patrol.

9. Client Responsibilities: The client agrees to bear any expenses with respect to the Referral Bonus Program. You acknowledge, understand and agree that all Sales Agreements with Customers will be Home PC Patrol’s standard Terms & Conditions and you will not provide to any person or entity any representation, warranty or commitment relative to the Home PC Patrol’s services other than as expressly set forth therein.

10. Bonus Period: Home PC Patrol reserves the right to discontinue Discount Credits or the Referral Bonus Program entirely for any reason, at any time and for any duration at its sole discretion, and without notice. In the event of discontinuation of this program, Home PC Patrol will honor previously 'banked' credits to active clients within our service area. Should Home PC Patrol discontinue service to your geographic area, or cease business operations entirely, existing Discount Credits shall be deemed invalid and void.

11. Expiration of Bonus: Currently there is no expiration period on Discount Credits. Home PC Patrol reserves the right to alter this period at any time.

12. Variation of the Terms and Conditions: These Terms and Conditions may be amended or modified by Home PC Patrol at its sole discretion at any time and these amendments and modifications will apply to all clients utilizing the Home PC Patrol Referral Bonus Program. Any such amendments will be posted to this page, and it is your responsibility to review this page from time to time for such amendments.

13. Limitation of Liability for Home PC Patrol: TO THE FULLEST EXTENT PERMITTED AT LAW, NEITHER HOME PC PATROL NOR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR OTHER REPRESENTATIVES WILL BE LIABLE FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS OFFER. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES.

14. Severance: If any provision of these Terms and Conditions is held to be invalid, such invalidity will not affect the remaining provisions.

15. Governing Law: These Terms and Conditions will be interpreted, construed, and governed in all respects in accordance with the laws of the State of Ohio, without giving effect to its principles of conflicts of laws. You hereby irrevocably consent and submit to the exclusive personal jurisdiction of the state and federal courts in Sandusky, Ohio for the purposes of litigating any such action.
