Home PC Patrol is committed to protecting the privacy of our clients and make all best efforts to provide a safe and secure environment for our clients. This privacy policy ("Privacy Policy") is designed to inform you about the type of information that Home PC Patrol ("Home PC Patrol", "homepcpatrol.com","we", and "us") may gather or collect from you in connection with your use of our services ("Services") or this website (this "Site"). It also explains the conditions under which we use and disclose that information, and your rights in relation to that information.
BY REQUESTING OUR SERVICES OR VIEWING THIS SITE, YOU AGREE TO BE BOUND BY HOME PC PATROL'S PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS POLICY, IF YOU ARE UNDER 18 YEARS OF AGE, OR IF YOU ARE NOT PERMITTED BY LAW TO ENTER INTO LEGAL OBLIGATIONS, YOU SHOULD NOT USE OUR SERVICES OR WEBSITE. WE MAY MODIFY THE POLICY FROM TIME TO TIME AND POST THOSE MODIFICATIONS HERE. EACH TIME YOU USE OUR SERVICES OR SITE, THE CURRENT VERSION OF THE PRIVACY POLICY WILL APPLY. ACCORDINGLY, WHEN YOU USE OUR SERVICES OR WEBSITE, YOU SHOULD REVIEW ANY CHANGES SINCE YOUR LAST SERVICE OR VISIT. YOUR CONTINUED USE OF OUR SITE OR SERVICES AFTER ANY SUCH MODIFICATION CONSTITUTES YOUR ACCEPTANCE OF THE MODIFIED POLICY.
II. PERSONALLY IDENTIFYING INFORMATION
Home PC Patrol will collect personally identifying information including but not limited to: name, e-mail address, postal address, and telephone number, from the Client when the Client voluntarily requests Home PC Patrol perform service(s) on their behalf. Home PC Patrol will also collect personally identifying information from you when you voluntarily submit personally identifiable information to this website:
a. to register with the Site or use interactive parts of our Site where users can provide content and suggestions or participate in interactive discussions and/or
b. to participate in optional web events, online records management and scheduling, or when registering for news updates and alerts or promotional events.
III. AGGREGATE INFORMATION
Aggregate information is anonymous information that is not personally identifiable, including but not limited to: type of web browser, operating system, Internet Service Provider, and IP addresses. Every time a visitor, whether registered or unregistered) connects to any page on this Site, we may log that visitor's IP address. This practice is utilized by many websites and is implemented to track which pages are accessed most frequently and how long each page is viewed. As this cannot be used to identify individual service clients or website visitors; Home PC Patrol reserves the right to sell, share, or trade compiled aggregate information with third party entities.
a. Cookies are small text files that websites create and store on your computer in order to recognize you in the future. Home PC Patrol's tracking cookies make using this Site easier, as it allows you to register an account and stay logged in persistently as you navigate the Site. homepcpatrol.com also uses cookies to save your password for future visits. Third parties may use cookies as described in Section 4 below.
b. Cookies may be disabled at any time; however, if you do not allow cookies from homepcpatrol.com, then you may not be able to utilize certain features of this Site.
c. Many websites contain invisible images, often referred to as web beacons which allow a website to count the number of users who have visited specific pages. homepcpatrol.com currently does not utilize web beacons, but reserves the right to implement them at any time. If implemented in the future, homepcpatrol.com would only use web beacons within this Site for statistical purposes. Third parties may use web beacons as described in Section 4 below.
IV. ADDITIONAL INFORMATION AND SERVICE CLIENTS
Home PC Patrol will collect additional information from local or remote service clients including but not limited to: computer hardware and software configuration, internet browsing history, hardware and software diagnostic and repair reports, license and registration information. Most aggregate information does not contain personally identifying information in and of itself; however, when viewed in conjunction with other information should not be considered non-personally identifiable or anonymous information by the Client.
Any person or entity who purchases any service, whether local or remote, from Home PC Patrol is considered a Service Client; this includes but is not limited to: hardware or software service, website development, data recovery, SEO, consultation, or diagnostic services.
V. PERSONALLY IDENTIFIABLE INFORMATION: SERVICE CLIENTS
Home PC Patrol may use personally identifiable information with local or remote service clients for the following purposes:
a. validation of a Client's personal information for the purpose of entering into a contractual or service agreement
b. appointment scheduling or cancellation notifications
c. unsolicited corresponding or contact the Client regarding past or future service interactions
d. to notify Client that they are at risk of or currently experiencing virus, spyware, or malware infection
e. performing customer service activities
f. making available services to you or notifying you about new services or offers you may find valuable,
g. to inform you of product or component recall, software updates, program patches, or discontinuations
h. any direct communication between Home PC Patrol and the Client deemed necessary by Home PC Patrol technicians or staff
Any person or entity who purchases any service, whether local or remote, from Home PC Patrol is considered a Service Client; this includes but is not limited to: hardware or software service, website development, data recovery, SEO, consultation, or diagnostic services.
V. PERSONALLY IDENTIFIABLE INFORMATION: WEBSITE VISITORS
Home PC Patrol may use personally identifiable information for the following purposes:
a. to validate a user’s site registration
b. notifications of news and alert subscriptions
c. contacting a particular user by the homepcpatrol.com administrative staff
d. contest registration and results
e. any unlisted customer service activity as deemed necessary by homepcpatrol.com administrative staff
f. notification of current web services, changes to web services, new web service offerings, or discontinuation of web services
VI. DISCLOSURE OF INFORMATION: ALL CLIENTS & VISITORS
a. Home PC Patrol may disclose personally identifiable information to third partieswhen the Client consents to such disclosure. For example, if the Client indicates that they would like to receive information about the products or services of third parties, we may supply third parties such as program vendors, Internet Service Providers or others Client specific personally identifiable information for the purpose of sending you e-mail or otherwise communicating with you. Home PC Patrol may use Client data we have collected (such as installed programs, previous purchases, or registrations of similar products) to determine whether the Client might be interested in the products or services of a particular third-party.
b. Home PC Patrol may disclose personally identifiable information to companies and individuals we employ to perform functions on our behalf (“third party service providers”). Examples of such third party service providers may include companies who host our Web servers, recover damaged data, provide marketing assistance, process credit card payments. These third party service providers will have access to personally identifiable information only as necessary to perform their functions, but are not authorized to retain, share, store or use the Client's personally identifiable information for any purpose other than completion of the services for which they were hired.
c. Home PC Patrol may disclose personally identifiable information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith that such action is necessary to: (i) conform to legal requirements or comply with legal process; (ii) protect the rights or property of Home PC Patrol or its affiliated companies; (iii) investigate or prevent a crime or protect national security or any incident in which we believe that you have used your equipment or this site to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws; or (iv) protect the personal safety of users or the public.
d. Home PC Patrol reserves the right to transfer all personally identifying information in our possession to a successor entity in the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets. Other than to the extent ordered by a court, the use and disclosure of all transferred personally identifying information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and you affirmatively opt-in to accept it. Personally identifying information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor entity.
e. Home PC Patrol does not sell personally identifying information to third party marketing or advertising companies.
VII. DISCLOSURE OF INFORMATION: SERVICE CLIENTS
a. Home PC Patrol can, at its sole discretion, disclose any content found on the Client's computer that violates local, state or federal law, or contains any material that is illegal, libelous, tortuous, involves moral turpitude or appears indicative of the Clients intent to commit a crime which could result in bodily harm to self or others; including, but not limited to real or perceived: child pornography, child abuse, illegal or unethical behavior with a minor, terrorist activities, plans or admissions detailing the commission of a violent crime or intent to do so, or any content deemed morally or legally reprehensible by Home PC Patrol technicians.
b. Any information discovered in the course of authorized computer service is subject to this clause including but not limited to pictures, videos, documents, emails, internet browsing history, audio files, cookies, or temporary files including cache files; whether intact or partially deleted, whether present on an installed hard drive or external device provided with or attached to the computer at the time of service. External media such as CDs, DVDs, Flash Drives, or memory cards are subject to this clause if they are present in the device or provided directly by the Client regardless of whether their inclusion was intentional or accidental.
c. The client retains no expectation of privacy in regards to this information, and Home PC Patrol can, and must in some cases, disclose such information to third party sources including but not limited to law enforcement agencies, employers, family members, or any person who is the subject or target of any of the above described information. In the event the subject is a minor, the above information can additionally be reported to the child's parents or guardians, school administrators in the district in which the child attends, county departments of child and family services or any other entity deemed pertinent by Home PC Patrol.
d. Home PC Patrol does not have the resources or authority to investigate or determine the validity, origin, author, source, original context, or purpose for which this information was obtained by the Client; and in all disclosure instances, provides this information exclusively at face value to a third party entity(s) for further investigation. Home PC Patrol has no obligation to divulge to the Client that such information was disclosed or to whom it was submitted. By choosing to have Home PC Patrol perform service on their equipment, the Client agrees to hold Home PC Patrol free from harm in any disputes involving disclosure of information to third parties.
e. In no event will Home PC Patrol be liable for any consequential, exemplary, incidental, punitive, or special damages that arise as a result of any information disclosed to a third party, including but not limited to loss of profit, loss of data, loss of reputation, or loss of community standing.
VIII. DISCLOSURE AND DISTRIBUTION OF INFORMATION: WEB DEVELOPMENT CLIENTS
a. Home PC Patrol Web Development Clients should not post, transmit, or permit Internet access to information the Client desires to keep confidential. Home PC Patrol cannot and will not make any guarantee of privacy on information that you have displayed publicly on your website.
b. Home PC Patrol Web Development Clients are not permitted to post any material that is illegal, libelous, tortuous, or likely to result in retaliation against Home PC Patrol by offended users. Home PC Patrol reserves the right to refuse or terminate service at any time if the Client refuses to comply with requests to remove offensive content.
c. Home PC Patrol can, at its sole discretion, report, remove, or revise any offensive content found on Web Development Client's websites that are hosted, maintained, or developed by Home PC Patrol. Offensive content is any content that violates local, state or federal law, or contains any material that is illegal, libelous, tortuous, involves moral turpitude or appears indicative of the Clients intent to commit a crime which could result in bodily harm to self or others; including, but not limited to real or perceived: child pornography, child abuse, illegal or unethical behavior with a minor, national security threat, plans or admissions detailing the commission of a violent crime or intent to do so, or any content deemed morally or legally reprehensible by Home PC Patrol technicians.
d. The client retains no expectation of privacy in regards to this information, and Home PC Patrol can, and must in some cases, disclose such information to third party sources including but not limited to law enforcement agencies, employers, family members, or any person who is the subject or target of any of the above described information. In addition to the above provisions Home PC Patrol Web Development Clients agree not to publish content that is pornographic, promotes drug use or distribution, promotes hatred towards any race, ethnicity, or lifestyle choice, distributes spam or redirects to external sites that violate this provision, or that are used to deliver malware content to the end user. The preceding list is by no means all inclusive and Home PC Patrol reserves the right to remove any content at its sole discretion.
IX. THIRD PARTY ADVERTISING
Home PC Patrol does not currently utilize advertisements from third party advertising companies but reserves the right to do so at any time without notification. Should Home PC Patrol decide to use third party advertising companies, including but not limited to Google, Kontera, Tribal Fusion, or any combination thereof, to serve third party ads; these third party ads will be reasonably identifiable as coming from a third party. Third party advertisers may utilize cookies or web beacons, as defined above, to collect non-personally identifying information such as IP Address, and pages viewed. Home PC Patrol does not have access to, or control of web beacons or cookies utilized by third party advertisers. Information collection and disclosure practices utilized by third party advertisers are not covered by this Privacy Policy. Additional information regarding third party advertiser privacy policies can be found on the respective advertiser's website.
X. DATA SECURITY
Home PC Patrol adheres to generally accepted industry standards in regards to protecting your sensitive information from unauthorized access. Data that is stored on our servers is treated as confidential and is not made generally available to the public. Additionally, our servers are protected by firewalls and are located in secure data facilities to further increase security. Please keep in mind, however, that despite all reasonable efforts to protect your data, no method of data transmission over the Internet is guaranteed to be secure. Home PC Patrol strives to protect your personal data at all times; however, we cannot and will not guarantee its absolute security and shall not be held liable for any security breech perpetrated by an outside party.
